Anyway to finalize this wonderful discussion, let all of us, who have seen / discussed this issue, take an oath to never go via UK again. I join anybody who is willing to take this oath. "NO MORE TRAVEL TO INDIA VIA UK. I WILL PAY THE EXTRA $$$$ TO FLY VIA OTHER ALTERNATIVE ROUTES THAT DONT REQUIRE A TRANSIT VISA".

I wanted to put down the various steps I undertook or have happened since my PD got current in hopes that it might help anybody...
PD: Nov 2005 EB2 @ NSC got current in August.
We were in India when my wife got a FP notice in July. Missed it completely but was lucky that the lawyer realized we were on vacation and requested a postponement of FP appointment.
The original FP appointment notice was for July 7th and we never received a second appointment notice until Aug 20th.
In the meanwhileI travelled back to USA and opened SRs, Infopass and sent emails to NSC, Opended an Ombudsman inquiry, contacted senators separately for myself and for my wife. I got GC approval on August 10th.
My wife had her FP taken on Sept 3rd and today we received CPO email for her too. Good luck to all who are waiting and I suggest do everything you can like SRs, emails, contacting senators, ombudsman inquiry, infopass appts. Not sure what worked.
My Main conern was that my AOS (principal applicant) would be stalled because my spouse (dependent) had expired FPs and we missed an appointment. Apparently this turned out not to be the case.
Thanks IV for a lot of useful information. All the best to everybody.

This surely is an idea worth pursuing. Will require a real hard push. Where does one start other than writing on change.gov? In this economic environment this may be a real hard sell in my opinion. I think all will benefit from this naysayers too.

I dont know why everybody started to spit on ohio law firm. They just pointed out some news that they got from AILA, right? Lets hope its just a rumor and USCIS doesn't proceed with this revised thing. I am pretty sure that wont happen. Dont worry guys, but dont blame everything on ohio firm. I saw this on several other law firms too.
Before IV, immigration-law used to be the website to get consolidated information related to immigration news, Also most of the updates posted are based on the AILA updates/alerts. It is not fair to get mad at this site, just because he has posts/news that are not liked by vast majority of folks like us. I wish to see the VB dates current, but ��. we all know now, what is real... Retrogression and waiting...

There are a few praises about Jet Airways in previous posts.
Let me set the record straight. They have miles to go before they start claiming themselves as "world class" international airline.
I was on vacation past 2.5 weeks to India and here is my experience.
Regarding Jet Airways poor customer service:
On return, my Jet Airways flight from Rajkot (Gujarat) to Mumbai was delayed by 2 hours. Its only a 55 minute flight from Rajkot to Mumbai. Because of this, my connection of Delta airlines from Mumbai to New York was missed. Delta gave me a seat on plane the next day. Same flight - but a day after. So now, I was stuck in Mumbai, with huge luggage for 24 hours. I asked Delta for Hotel accomodation. They said, its not their fault and its Jet Airways fault and I should ask them for Hotel.
I went to Jet Airways customer service in Mumbai airport. They said that they cant find a single room in Mumbai due to some exhibition/conference going on at the time. A major international airline, shooting for stars, cant find a Hotel room in a city as big as Mumbai. Frustrated, I went to a government agency office (IATA I think) and they said that they dont have anything nearby, but can arrange something 30 kilometers away, and it was a sub-standard hotel and room. I paid out of my own pocket and stayed there a night. It was Rs 2000 (about $50) for this hotel plus taxi.
The next day, before boarding Delta flight, I went to Jet Airways office again and told them that I found a hotel room on my own and see if they can re-imburse me for the hotel expenses. If they had paid themselves in Hyatt or Grand Meridian outside airport, it would have been more anyways. The manager of Jet Airways said that they cannot do it and I should scan the reciepts and my boarding pass and email customersupport at jetairways.
An hour before this happened, the office didnt even have anyone in charge in office (at about 7:00 PM). The agent said, the manager isnt here. I asked, "who's in charge", and she said "No one is in charge right now, you have to come back at 8:00 when manager comes in".
What I am saying is, Jet Airways has miles to go before it can take pride. Just starting flights to Newark, Chicago doesnt make it a great airline. Neither does good food. Treat customers well, and atleast do a better job than government offices when it comes to locating hotel rooms for stranded passengers who are stranded due to their fault.
Mumbai Airport security harrassment :
My flight was just past midnight and I checked out of hotel at noon. (I had to). With 12 hours and nothing to do, I headed to Mumbai airport. At the airport, they dont let you inside the building unless you are a passenger. The security guard at the door said that I need to come back at 9:00 PM and I cant go into the airport right now as my flight is at night. I told him that I am not coming to airport to enjoy the lounge and I am stranded due to missed airline connection. He didnt listen. I was sitting outside the building until about 8:00 PM with all luggage.
Now I understand that security is important, but what's the point in stopping someone and letting them inside only 4 hours prior. Because if there is a nefarious person planning something bad, what can he/she do in 10 hours that he/she cant do in 4 hours. How does it enhance security by limiting the presence of passengers inside airport? Well, you cant argue with knuckleheads.
Inside airport, I ran into a German lady and a guy from Netherlands and both of them were in the airport since the afternoon. They said they argued and they were let in. Basically, the Indian security forces at the airport wont argue with Europeans and will let them inside the airport but will go extra lengths to harrass people that they are comfortable harrassing - their own people.
So we can ignore London airport. Fine. Are we also going to ignore Mumbai airport now?
The best way to avoid harrassment is to stand up and fight it. Because avoiding this airport and that airline is not going to cut it.

I'm a great fan of Obama for what he has achieved so far and in all probability he will in Nov. I hope the new CIR will not be similar to CIR 2007 as far legal immigration is concerned. After 8 years of paying taxes I would definitely feel greatly disappointed if we get a raw deal for being legal

Finally, 5882 is our only hope for now.
With the earlier method or the current method, EB3-I will always end up last. Vertically EB3-ROW gets the excess visas (old method), horizontally EB2-I gets the excess visas (new method). So, either way EB3-I won't benefit, the only solace being that with the current system atleast our EB2-I friends are getting their freedom faster.
For us, visa recapture or other legislative changes are the only relief.

I have decided to use AP and have cancelled my appt in Chennai.
I have an appointment at Kolkata on the 11th. Scheduled to fly back to US on the 26th. Considering Martin Luther king Jr day it will be 9 working days. After seeing the PIMS delays, I am seriously considering return back on AP. Cannot take the risk of delaying the flight as I dont have vacations to hang around and wait for PP.

So I was having lunch at the Four Seasons with Lou Dobbs the other day, locked in disagreement over who cared more about working people, him or me.
Him: CNN host, biggest and loudest gun in the battle for tougher immigration policies, leader of a nightly crusade to expose the misdeeds of those he views as elitist fools and scoundrels.
Me: editorial writer whose views on immigration qualify, to Mr. Dobbs and many others on his side of the debate, as elitist, foolish and scoundrelly.
Meeting at the Four Seasons was his idea, to continue a long, civil and inconclusive phone conversation about immigration. I got there early and waited at Mr. Dobbs�s banquette. I looked around the hushed room, full of dark suits and a wintry glow. Mr. Dobbs appeared and settled in, his drink, cranberry juice and seltzer, materializing at his right elbow.
In the spirit of the occasion, I ordered strictly within our borders: lobster bisque, filet of bison and New York tap water. He had the Dover sole.
Among people whose immigration views I admire, Mr. Dobbs has a reputation as a hopeless blowhard. I did not dwell on that at lunch. I was his guest, and I had seen what happens if you try to skewer him with insult or accusation. Mr. Dobbs is unencumbered by self-doubt. The granite fortress of his certitude is smooth and featureless, and whatever boulders you hurl at it will end up on your head. Besides, I was looking for something better than an argument. I wanted to convert him.
An honest person must concede a lot when arguing immigration with Mr. Dobbs: Yes, the borders and ports are insecure, and poor countries like Mexico have done too little to solve their economic and migration problems. Yes, illegal immigration hurts some Americans, globalization causes many global problems and big corporations love to stick it to the little guy.
My point to Mr. Dobbs was that the little-little guy � the �illegal alien� crossing our �broken borders� � was the wrong target. His overriding emphasis on solving globalization�s many ills by urgently sealing the borders strikes me as populism gone astray.
First, it�s ineffective, because the country will never be ziplocked as tightly as he wants it to be. The price of trying is too high, and it ignores the millions who enter the country legally but overstay. Most shamefully, it does nothing to resolve the fates of the 12 million undocumented already here.
Second, the obsession with enforcement dovetails with the agendas of some nasty people: the nativists for whom immigration is a simple case of brown and white, of preserving �American� culture by keeping Latinos out.
Third, it does too little to attack the evil corporate elites that are Mr. Dobbs�s sworn enemy. What makes illegal immigrants so delectable to big, bad business is their illegality � their willingness to work cheap and under the table. So why not legalize and tax them? Assimilate the good guys, as this country has always done, and save law enforcement for the bad ones.
The idea is to confront abusive corporate power with worker power. If day laborers end up in our suburbs, where the money and jobs are, then give them safe places to gather and help them work together to keep from driving wages and working conditions down. If companies take advantage of workers, empower the workers to fight back: as union members, legal residents, citizens.
But that�s �amnesty,� a Dobbsian expletive. It�s the opposite of the crackdowns endorsed by him and the hard-liners he praises, like the Minutemen.
Mr. Dobbs listened graciously and budged not. He said he respected immigrants, even illegal ones, who he felt had gotten an unfair shake from their governments. He reminded me of his fondness for Cesar Chavez.
Then he repeated his immigration credo. It went like this: the 1986 immigration law was an amnesty promoted by corporate interests waging war on the middle class. Thus the 2006 and 2007 reforms were also amnesty, pushed by the same self-serving plutocrats. So nothing they want is worth doing � at least not until the border is sealed.
That could be a long time. While we wait, I am going to keep trying to convince Mr. Dobbs that a comprehensive solution � enforcement plus assimilation � is the best expression of the populism he espouses.
Mr. Dobbs admits that mass deportation would never work, although if you press him on what to do about the 12 million, he has no answer. He wants to hold that question �in abeyance� until the border is sealed. I find that oddly passive for someone so convinced of the dangers from the aliens in our midst.

Guys,
Thanks for your wishes. As much as I feel it as a journey I still consider myself lucky seeing so many people with PDs earlier than me both for EB2 and EB3 still languishing. We all consider FIFO to be fair and it is hard for us to decipher why it is not followed by DHS.
My suggestion to you all is that if you are told that your case is with an IO ask him or her if an email can be sent to that IO that you are concerned. This is exactly what I told Janet on Friday, one of the good CSRs from TSC. I had told her that knowing a case is with an IO is of no help to me if that IO is on vacation or is sick or is not aware that the case is current.
Also if you guys had followed my never ending streak of mails, I had mentioned that my wife had got a call from a CSR at DC probably in response to her SR that I opened or my concerned and frustrated mail to Napolitano...she was told that her case is with an IO and that since the case was transfered her Biom had not been uploaded and that she is ordering new Biom request and she should get it done...I had told her that by the time we receive it the visas may be over and also how come I am approved....moral of the story is "THEY KNOW NOTHING" as Jim Cramer used to say.
The only person I found reliable was this Ms Beck at TSC who I was fortunate to get hold of exactly 2 weeks back and she had told that we don't need new FP and Biom it just needs updating by the IT dept and she is sending a request to that effect...I had asked her how long should it take and she had told me 2 weeks..she also told me you will get your card b4 your wife.....and she may be a bit delayed but will get approved.
So guys from TSC keep trying and hope to get this Ms Beck...you can alway ask the person's batch number and name and don't waste your time if you get someone else.

Thanks for your wishes. As much as I feel it as a journey I still consider myself lucky seeing so many people with PDs earlier than me both for EB2 and EB3 still languishing. We all consider FIFO to be fair and it is hard for us to decipher why it is not followed by DHS.
My suggestion to you all is that if you are told that your case is with an IO ask him or her if an email can be sent to that IO that you are concerned. This is exactly what I told Janet on Friday, one of the good CSRs from TSC. I had told her that knowing a case is with an IO is of no help to me if that IO is on vacation or is sick or is not aware that the case is current.
Also if you guys had followed my never ending streak of mails, I had mentioned that my wife had got a call from a CSR at DC probably in response to her SR that I opened or my concerned and frustrated mail to Napolitano...she was told that her case is with an IO and that since the case was transfered her Biom had not been uploaded and that she is ordering new Biom request and she should get it done...I had told her that by the time we receive it the visas may be over and also how come I am approved....moral of the story is "THEY KNOW NOTHING" as Jim Cramer used to say.

If I mention: "I plan to travel outside of USA for family reunion" in the I-131 cover letter, do you think I will got denied because this reason is not "compelling emergency" at all?

I have got email from my lawyer too regarding the change in bulletin coming MONDAY. I am worried for my life again. Is this all worth it? Title of her mail is I-485 could be rejected in July. I am done with this damn life. I can't take it anymore.
I really feel like crying now. Sitting on h-4 for 4 years and now I see a ray of hope and that is squashed too. I don't think this is fair. This is just not fair. Why the hell in the first place they have to make it current? I feel bad for all of us.
How many hours, how much money, how much effort, feelings, aspirations, hope. so much was built on that one news and the days from then on. and today it is NOTHING. I am sick and tired of this life.
Who is there to listen to us? NOBODY. Who will straighten this mess for us? NOBODY. We support each other and today we again have just one another to fall through this.
