I have failed to see where IV has been showing discrimination or bias towards Eb2 versus Eb3?
Not taking up a specific Eb-3 cause does not tantamount of neglecting Eb-3. Has IV done something in past 'proactively' for only a certain category of Eb? If not, then how can we accuse IV of ditching Eb3, at the same time?
No one is saying that IV is ditching Eb3.Everyone(at least EB3 guys) is saying that EB3 needs special attention because it's movement is dead now.

Coming to DC will be a memory most of us will cherish... and for a really long time...
Whether it was working late or eating dinner at 3 am or running to meetings, it was an enriching experience for all IV members. And it makes us proud that we stood up & made our presence felt & voices heard...
We all knew each other by IV handles... but meeting in DC put names & faces to those handles...
Meeting each & everyone was amazing and even more satisfying was that people came from different states & with families & kids...
A li'l disappointed with the locals who didn't turn up though.... and more so with those who walked on the other side of the road from all of us....

My husband's I-140 will be approved in few days and our PD is current right now. Once the I-140 is approved we are planning to file for I-485 the sooner possible. The main reason is for me to apply or EAD so that I could work. You should also consider that I am travelling on July/august and of course I will require a visa appointment at the consulate to stamp my H-4.
My questions are:
1- Is it safe to apply (once the I-140 is approved) before leaving U.S. For I-485 and EAD together?
2- What documents are required to file for EAD besides what is already being sent with the I-485?
3- What are the potential problems in leaving the country in July with an I-485 (with or without EAD, please tell me in both cases) submitted, and having a visa appointment at the consulate abroad in August to renew my h4 that expires in NOv 2007? Should I wait and apply for I-485 or EAD until Sept 2007?
In short: Could anyone please advise regarding the risks of filing in June the I-485, travel in July, have a consulate appointment abroad in August to stamp the H-4 visa that expires in Nov 2007 ? Should I wait until I come back? Much appreciated any replies.

Now that the House and Senate have adopted different versions of immigration legislation, textbook explanations of lawmaking suggest the bill's fate rests in the hands of a conference committee. Congress uses these temporary bicameral panels which some call the "Third House" of Congress to resolve differences in competing versions of legislation.
But lawmakers often find exceptions to textbook explanations and immigration reform provides a case in point. True, most predict contentious House-Senate negotiations on the issue. But "where" and "when" are key questions. Creation of a conference committee will be more an indication that a deal is done than a forum to find one. In other words, lawmakers may not even officially create a bicameral negotiating panel until they have found a clear path toward a workable compromise a process that may take weeks of private, informal discussions before conferees ever formally meet.
Conference committees are not mandatory. They offer one way to resolve differences between chambers, but there is no requirement that lawmakers even use this procedure. According to Walter Oleszek at the CongressionalResearch Service, only 15 to 25 percent of all laws passed by Congress ever reach the conference-committee stage. Lawmakers normally resolve differences either by one house adopting the other's version or by "ping-ponging" measures back and forth until substantive disagreements are ironed out. Conference committees are never formed in either of those cases.
However, Mr. Oleszek also notes that most controversial bills that become law do go through the House-Senate conference process. Immigration definitely clears the divisiveness threshold. But sending a politically charged bill to a formal conference immediately and hoping differences get resolved there is not a tactic preferred by the GOP leadership.
When lawmakers do decide to form a formal conference committee, its procedures are exercised in congressional discretion with only a few set rules and precedents. The House and Senate each choose members drawn heavily from the committees that authored the legislation. In the Senate, the presiding officer appoints from a list developed by the chair and ranking member of the committee that passed the bill. In the House, the speaker appoints all conferees and sometimes draws in members of the leadership. Each house has one vote on issues under consideration in the conference; therefore there is a "House position" and a "Senate position" on any provision in disagreement. Each chamber develops positions based on a majority vote of conferees from that body.
Neither chamber is under any obligation to respond to a request for a conference. And sometimes the bulk of negotiations occur in a pre-conference informal setting. House leaders are averse to sending major legislation to a formal conference with the prospects of long, drawn-out deliberations. For one thing, after a bill goes to conference and there is no resolution in 20 calendar and 10 legislative days, any member of the House can offer non-binding motions on a daily basis, which often subjects the body to tedious, sometimes politically embarrassing votes that eat up valuable time.
Democrat obstructionism in the Senate may also stall efforts to convene a conference. Since losing the majority after the 2002 election, Democrats have made the historically routine process of going to conference (which is normally done through unanimous consent) a procedural jungle. On the immigration measure, Democrats insisted on the unusual step of a pre-agreed ratio of conferees (26 senators total 14 Republicans and 12 Democrats) before entering into a unanimous consent agreement to finish the bill. Also, because the Senate bill contains a revenue provision, it is subject to a so-called "blue slip," which means it could be automatically rejected by the House. (The Origination Clause of the Constitution requires all revenue measures to begin in the House. A Senate bill containing revenue provisions is sent back with a resolution printed on blue paper, hence the name.) Democrats then objected earlier this week to efforts to attach the Senate immigration bill to a House-passed revenue bill, which would have fixed the problem.
And when it comes to national issues like immigration, the White House also becomes a big investor in this legislative real estate. Thus, the real "conference committee" on immigration reform will take place informally between the White House and a handful of congressional leaders. If these lawmakers see a compromise that can garner strong support among Republicans in the House and Senate, a formal conference will be appointed.
If this path can't be found, it's unlikely lawmakers will ever formally set foot into a conference committee to orchestrate a compromise in public or private.

Its a classical case of too many people and very few visa#. Every one has a valid point
1) One group says I have oldest PD I am waiting since 8 years so I need to get GC
2) Second says I have a better category (EB1 & EB2) so I need to be given preference
3) Third group says I was qualified for EB2 but company & lawyer pushed me to EB3
4) Fourth group Say I have MS PhD from US so preference is mine
Actually all 4 have valid justification but the # are so few that you pick one point and you hurt other groups. So conclusion is Admin fix will only help one interest group but it is possible. Immi reform will help everyone but is difficult/ impossible

I am also struggling to get my GC. It is my 9th year in H1B visa. My intention is, atleast we can reduce the period for waiting to get the citizenship. It can also be considered as a good benefit for our community. Just my thoughts...
Why do I get a feeling you are incapable of digesting the concept of "Law of the land". There are certain rules that govern PR & Citizenship statuses ( of all countries)and only land mark & ground breaking edicts can alter such law’s , and that too very slightly. To put it were tersely "this is a bullshit suggestion" and is really wasting the purpose of this forum. The only reason so many people have responded is that it is "THAT RIDICULOUS"

Everybody, please calm down. I don't know what the intention of this thread was, but if it is to increase the participation to achieve IV's goals, then I am sure you all realize it is having the exact opposite affect. The only thing happening on this thread is donors and non-donors going at each other in a way of unbecoming of us professionals.
I am sure we can agree to disagree with respect. Think about some of the messages written and you wonder would it be really said if they were facing the person.
I personally don't think bitzbyte is or was berating IV's efforts. All he/she needs is more convincing. And I don't think he/she is alone. If that was the case then we would be having 49000 members donating and the advocacy effort would be a grand success and we would be having millions for lobbying. The fact is that there are more like bitzbyte than the donors. I am not sure where the problem is but there sure is. Heck, I am donor and I don't find myself talking about IV or hearing about IV from colleagues or friends. Everybody has their priorities set and the daily grind to go through. Getting a GC may not be everyone's ultimate goal. There was a time I used to be so obsessed with GC that my whole life seemed to be revolving around bulletins and the disappointment of backlogs. One day I said enough is enough and stopped worrying about it.
But I realized that the question is not about whether and when I get GC, but is it fair, to you and your family, to go through years of this agony. It is not fair and we have to do something about it.
As much as everybody needs IV to address their needs, IV needs them to achieve our collective goals. Lets think about ways to increase participation rather than marginalizing those that don't yet believe.
1. You have stopped worrying because you got your EAD at least.
2. USCIS is not asking to prove relationship with your great grandparents every time you go for H1B extension
3. You don’t need to worry about the VO at POE or consulate and not postponing your India trip for 3-4 years now.
4. Even though you are on project and pay roll is running, paying the tax...don’t lose your sleep over what memo comes next before the next H1B extension.
Our people are not worrying until it strikes them. Till then they will ask all sorts of questions and have attitude of why should I donate. You can see now and then a thread on IV - Help urgent, I-485 denied, H4- denied.
Why its urgent now for them...?

Here are few clarification Nix. Not that I need to explain to you but for all peop here
Pappu Thanks for your support
I will post relevant ideas as we gather momentum
My answers to your post are color coded in GREEN
(1) I found a unique way to cope with the stress of our immigration nightmare.
through Day trading??
Dude Day trading is stressfull if you dont know what you are doing ?
(2) It is not easy and it is not for the weak hearted but the rewards are wholesome and tremendous.
(3) Now lets Play !!!!!
Have you just tried to sell Day trading to IVians??
Relax Nix Probably this post aint for you . Why the hell do I need to sell anything to you. I am sharing what I feel is a great way to channalise negative energies towards something useful.
LMAO. I am sorry but I disagree that Day trading is an investment. Day trading is risky business and one needs plush amounts of cash as SIPC/SEC will not release the money on the same day. Don't even get me started on the margin accounts.
It is risky FOR SURE . It is a s risky as much as Crossing road is risky for the blind
People who can see can cross with ease provided they are not careless and have good judgement
I agree with (2) and would also like to point out that the risks are also substantial. One can get addicted to day trading and I dont need to tell what addiction can do to any one.
Nix people are addicted to VB too wht did they achieve.....Here atleast I am doing something progressive.
It needs time during work hours. ie 9 30 am and 4 30 pm. A lot of people did day trading during the dot com boom and recently with FRE & FNM. We know the results.
Well I am guessing your knowledge of day trading is limited to what Wikipedia has to offer. I work 9.00 5.00 Software engineer (no pun intented) And I make a decent 50-100 on the side .
While you might have taken refuge in day trading for the stress immigration has caused, it can be a serious double whammy/nightmare if the calculations go wrong.
Well Day traders that I have seen sucessful have NEVER EVER suggested to go all in. Play small play consistent
All said, if you feel that there is enough money to be made and normal Joe Bloggs can cope up with the pressure, please share your thoughts in detail.
I wanted to address this post first cause I want the notion that this is for my benefit to be outted. I have been here long and supported IV in all ways possible.

I want to add 'Family and Relatives pressure' in addition to 'Peer Pressure'. When I visited India lasttime, I was asked by almost all the relatives if We had bought a house. It has become an indication if we are doing well (earning well). After a while, i felt little bit uneasy to say that we did not buy house while many of our cousins already did. thats family pressure.
Other than for monetary reasons, there is a small group of people, who do not buy house even if they can afford to and live in apartments
- still not decided where to settle down,
- want to move to warm place, but just not yet due to job,
- think it is lonely to live in a big house with unfamiliar neighbors.
- have small kids, takes lot of time to meet their needs after work, daycare. cannot take the burden of maintaining a big house.
[QUOTE=nixstor;312477]
Peer pressure
Lets take fictitious families R & S living in the same rented community with similar back ground. Mr and Mrs R decide to buy a home and they buy one. Mr S does not think it is right for them to do so. How ever, Mrs S pressures Mr S into doing so. Believe me this happens all the time.

- want to move to warm place, but just not yet due to job,
- think it is lonely to live in a big house with unfamiliar neighbors.
- have small kids, takes lot of time to meet their needs after work, daycare. cannot take the burden of maintaining a big house.

Some porter gave me red on this post.
You will understand later my brother. After you get the GC when you look back. You will say to yourself "Wow, I was being so small and petty minded: I was bashing up real people for a piece of plastic". That is the time we can meet and be friends
Value of a "person" will be known when he is gone. But the worthlessness of material thing gets realized when it actually comes. Character of a person is truly tested during trying times. May you reminisce about it later and wonder why didn't you do better
Good luck. And BTW I was not the guy who gave you red.
About this message: It's not just for MC, but many, many more of you. Is it really important that you won the race in life, more than how people remember you? I am not "targeting" anyone in particular, just indulging myself with some philosophy. Peace.
